Last updated: March 8, 2026

SMS Nexus ("we," "our," or "us") is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our multi-carrier SMS platform, website, and related services (collectively, the "Service").

1. Information We Collect

Account Data

When you create an account, we collect your name, email address, phone number, company name, and password. If you register as a reseller, we may also collect business identification information and tax details.

Usage Data

We automatically collect information about how you interact with the Service, including IP addresses, browser type, operating system, pages visited, features used, timestamps, and referring URLs. This data helps us improve the Service and diagnose technical issues.

Messaging Data

When you send or receive messages through the Service, we process and store message content, sender and recipient phone numbers, delivery status, timestamps, and carrier routing information. Message content is stored to provide conversation history and is subject to our data retention policies.

Payment Data

When you purchase credits or subscribe to a plan, payment processing is handled by third-party processors (such as Stripe and PayPal). We do not store your full credit card number. We retain transaction records, billing history, and credit balance information.

2. How We Use Your Information

We use the information we collect to:

  • Provide, operate, and maintain the Service
  • Process and deliver SMS and MMS messages through our carrier network
  • Process transactions and manage your credit balance
  • Send you service-related communications, including account verification, billing notices, and security alerts
  • Respond to your comments, questions, and customer support requests
  • Monitor and analyze usage patterns to improve and optimize the Service
  • Detect, prevent, and address fraud, abuse, and technical issues
  • Comply with legal obligations and enforce our Terms of Service
  • Provide reseller analytics and commission reporting where applicable

3. Data Storage and Security

We implement industry-standard security measures to protect your personal information, including encryption in transit (TLS/SSL) and at rest, secure password hashing, two-factor authentication support, and regular security audits. Your data is stored on secure servers with restricted access controls.

While we strive to protect your information, no method of electronic storage or transmission is 100% secure. We cannot guarantee absolute security but are committed to promptly notifying affected users in the event of a data breach.

4. Third-Party Services

We work with third-party service providers to deliver the Service. These include:

  • SMS Carriers: We route messages through multiple carriers (such as BulkVS, Thinq, Telnyx, Sinch, and Commio) to deliver your messages. Carrier partners process phone numbers and message content as necessary for delivery.
  • Payment Processors: Stripe, PayPal, and other payment providers handle financial transactions. Their use of your payment information is governed by their respective privacy policies.
  • Infrastructure Providers: We use cloud hosting services to store and process data securely.

5. Data Retention

We retain your account information for as long as your account is active or as needed to provide the Service. Message logs are retained for up to 90 days by default, though this period may vary based on your plan. Transaction records are retained for 7 years to comply with financial regulations. Upon account deletion, we will remove your personal data within 30 days, except where retention is required by law.

6. Your Rights

You have the right to:

  • Access: Request a copy of the personal data we hold about you.
  • Correction: Request correction of inaccurate or incomplete personal data.
  • Deletion: Request deletion of your personal data, subject to legal retention requirements.
  • Data Portability: Request your data in a machine-readable format.
  • Opt-Out: Opt out of marketing communications at any time. Note that service-related communications (billing, security) cannot be opted out of while your account remains active.

To exercise any of these rights, please contact us at support@smsnexus.com.

7. TCPA Compliance

SMS Nexus is designed to help you comply with the Telephone Consumer Protection Act (TCPA) and related regulations. We provide opt-out management (STOP keyword handling), consent tracking tools, and message logging. However, you are responsible for ensuring that your use of the Service complies with all applicable laws, including obtaining proper consent from message recipients before sending marketing or promotional messages.

We use cookies and similar tracking technologies to maintain your session, remember your preferences, and analyze how the Service is used. Essential cookies are required for the Service to function. You can control cookie preferences through your browser settings, though disabling essential cookies may impair functionality.

9. Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or other factors. We will notify you of material changes by posting the updated policy on our website and updating the "Last updated" date.
